Thank you for visiting the www.joinGroups.com website and/or using a Join Groups mobile application, and reviewing our Privacy Policy. This policy explains how we handle information about your visit(s) to Groups’ site or mobile application, how we protect your privacy and anonymity, and how this site may be linked to other sites. We value your privacy and we’re committed to handling your personal data in a safe and secure manner.

“Protected health information” as defined in the Health Insurance Portability and Accountability Act (“HIPAA”), including information you provide to Groups Recover, Inc. while being treated as a patient is separate and subject to the HIPAA NOTICE [1] .

1. Introduction

This policy (the “Privacy Policy”) is applicable to this website (the “Site”) and the mobile application (the “App”), which are provided and operated by Recover Together, Inc. (“Groups” or “we” or “us”). PLEASE READ THE FOLLOWING TERMS CAREFULLY BEFORE USING THE SITE. The Privacy Policy explains how your personal data is used, shared and protected, what choices you have relating to your personal data, and how you can contact us.       In addition, particular features, applications and activities offered as part of the Site or the App may be subject to additional privacy terms specified in connection with such features, applications and activities.

Please note that this Privacy Policy applies only to information collected via the Site or the App. It does not apply to information that you may submit to us by any other means or to Websites maintained by other companies.

This Privacy Policy is incorporated into, and part of, Groups’ Terms and Conditions (“Terms and Conditions[2] ”). Capitalized terms not defined in this Privacy Policy have the definitions in the Terms and Conditions.

If we decide to update our Privacy Policy, we will post a note explaining the changes on this page. If we materially change the way in which we process your personal data, we will provide you with prior notice, or where legally required, request your consent prior to implementing such changes. We strongly encourage you to read our Privacy Policy and keep yourself informed of our practices.    

2. Personal Information

In connection with your use of the Site or App, or particular features or components thereof, you may be required to provide, and we may collect, information unique to you that can identify you personally or that can be used with other sources of information to identify you (“Personal Information”). For example, if you create an account or purchase services on the Site or App, you will be asked to enter your name, email address, demographic information, phone number, payment or credit card information and billing address. You may also provide Personal Information when you request customer service or other assistance, sign up to receive emails or text messages or other communications from us, or otherwise communicate with us via the Site or App.

Personal Information also includes data that Groups collects about your computer, mobile device, or other device that you use to access the Site or App (which may include, for example, IP address, geolocation information, unique device identifiers, browser type, browser language, and other transactional information) and about your use of the Site or App (which may include, for example, a reading history of the pages you view).

Access to software applications that are owned and operated by third parties (“Third-Party Applications”) may require you to provide access to your Personal Information to the providers of such Third-Party Applications. In such cases, you will be informed about this either during the registration process, in the terms of use of the Third-Party Application, or in a similar manner. The Third-Party Application provider’s use of your personal information is governed by that third party’s privacy policy. Please note that if you choose to remove a Third-Party Application from your Groups account, this does not necessarily mean that the relevant third party provider will delete Personal Information about you that they have previously received. Please visit the privacy policy of the relevant third party to make sure that you understand how they may use the Personal Information you provide to them. If you do not want such use of your Personal Information, you should not register for or use the applicable Third-Party Application.

3Use of Cookies

Like many websites, Groups may use “cookies,” tracking pixels and related technologies. These are files stored on your computer’s hard drive or on your mobile device that help Groups identify account holders and optimize the Site experience.

Most browsers accept cookies automatically. Groups recommends that you leave cookies enabled so it can offer you a better Site experience. If you choose to do so, you can modify your browser preferences to block or restrict cookies if you do not want your web browsing activity tracked. You may occasionally receive cookies from Third-Party Applications. Groups     does not control these cookies, and these cookies fall outside the scope of this Privacy Policy.

4.  Our Use of Information

We use the information we obtain from or about you to help us operate the Site and personalize and improve your experience with the Site and/or the App and to make certain features, service, activities or functionalities available to you. For example, we may use information we collect (including Personal Information) to:

●     Create an account in order to receive services from Groups;

●     Provide you with services that you request;

●     Communicate with you about your account, respond to your inquiries and send you information (via email, SMS text message, push notification or the postal service) about features and enhancements of the Site or App;

●     Communicate with you about changes to our policies;

●     Send you newsletters and other communications;

●     Optimize or improve our services and operations;

●     Detect, investigate, and prevent activities that may violate our policies or be illegal; and

●     Perform statistical, demographic, and marketing analyses of users of the Site or/or App and Site and/or App usage, including analysis of which content or images users click on or hover over and analysis of which email messages were opened or acted upon when Groups      sends email messages.

We may use and store information about you that we receive from other sources to enable us to update and correct the information contained in our database and to better customize your experience with the Site and/or App.

5. Disclosure of Information

We will only disclose your Personal Information collected via the Site and/or the App to other companies and individuals as described in this Privacy Policy, or as separately authorized by you.

We may disclose aggregate or de-identified information and any other information that is not Personal Information to other companies and individuals in any manner that Groups deems appropriate or necessary, inclusive of for marketing, targeting and analytical purposes.

Service Providers

Groups occasionally has third-party contractors,  and agents and other vendors and service providers that provide services to Groups, such as credit card processing, marketing, database hosting, web analytics, and providing customer service. These entities may have access to Personal Information in order to perform their functions. We do not authorize them to use the information we share with them for any other purpose.

Legally Compelled Disclosures

Groups may disclose Personal Information to government authorities, and to other third parties when compelled to do so under law (including under a reasonable interpretation of the law), including, without limitation, in response to court orders and subpoenas.

Emergency Situations

Groups may disclose Personal Information if required to do so by law or in the good-faith belief that such action is necessary to: (a) conform to applicable law; (b) protect and defend its rights or property, the Site and/or the App or its users, and (c) act under emergency circumstances to protect the personal safety of Groups, its users, and others.

Affiliated Entities

We may disclose Personal Information and other information collected from you to our parent companies, subsidiaries, and/or affiliates.

Change of Ownership or Corporate Organization

We may change our ownership or corporate organization. We may transfer Personal Information to another entity in connection with any change of ownership, change of corporate organization or similar transaction, such as, for example, a transfer an entity with which we have merged, that we have acquired or that has acquired Groups Under such circumstances Groups      would use reasonable efforts to require the transferee to follow the practices described in this Privacy Policy, as it may be amended from time to time.

6. Records Retention

Groups retains your Personal Information for as long as required to satisfy the purpose for which it was collected and used, unless a longer period is necessary to fulfil a legal obligation.

7. Security

We make commercially reasonable efforts to keep your Personal Information secure using appropriate technical, physical and organizational measures to prevent against unlawful use, alteration, unauthorized access accidental destruction and loss. We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information.

No transmission of data over the internet is guaranteed to be completely secure, however. It may be possible for third parties not under the control of Groups      to intercept or access transmissions or private communications unlawfully, including in the case of your contacting Groups by email or a “contact us” or similar feature on the Site and/or the App. Accordingly, though Groups may take reasonable steps to protect the security and integrity of all Personal Information provided to the Site and/or the App, due to the nature of the internet, Groups cannot guarantee that information, during transmission through the internet or while stored on its system or otherwise in its care, will be absolutely safe from intrusion by others, such as hackers.      

8. Children

This is not a website directed to children under the age of 13, and Groups      does not knowingly collect personally identifiable information from children under 13 years of age. If you are under 13 years of age you should not use this Site or the App, and under no circumstance should you provide personally identifiable information to Groups.

9. Local Law

The Site and the App are published in the United States. We make every effort to protect the personal identifiable information of all users of the Site and App. We attempt to comply with local data protection and consumer rights laws to the extent they may apply to the Groups services. If you are uncertain whether this Privacy Policy conflicts with the applicable local privacy laws where you are located, you should not submit your Personal Information to Groups                 

10Communication and Contact

We may need to contact you in relation to services offered by Groups. Certain communications may be of a sensitive nature and could include your medical information. If you share with another person or people a phone, email address or home address, other people may intercept or view communications, and that such an event is outside the control of Groups. Groups Recover Together — SMS Privacy Statement

Effective April 7, 2021

This Privacy Statement (the “Statement”) governs how Groups treat the Personal Information that we collect and receive from you in connection with your use of our SMS Service (the “SMS Service”), which we make available via a third party service provider. The SMS Service is a way that Groups may contact you using a third party SMS service provider to facilitate SMS text messages containing appointment reminders, updates, announcements, or other general messaging. The Statement is incorporated in the Privacy Policy, and all capitalized words in the Statement shall have the same as those defined in the Privacy Policy, unless otherwise noted herein.

By using the SMS Service, you acknowledge that you have read and understand this Statement and the Privacy Policy. Groups reserves the right, in its sole discretion, to modify or change this Statement at any time with or without notice to you. The date of the last update will be posted at the top of the Statement, as well as a brief synopsis of any material changes, and will become effective when posted. Your continued use of the SMS Service following the posting of changes constitutes your acceptance of such changes.

For this Statement, “Personal Information” shall include any information we collect from you to facilitate the SMS Service, including your mobile data. 

What Personal Information is Collected About You?

We, our third party service providers, collect your name and mobile phone number in order to provide the SMS Service to you.

How is your Personal Information Used?

We, and our third party service provider, use your Personal Information to: a) provide the SMS Service to you; b) improve the SMS Service; c) contact you with announcements or messages; and/or d) conduct research.

How is your Personal Information Disclosed? 

We will share your Personal Information with our third party service provider to facilitate the SMS Service. We will never sell your mobile data to any third party, and we will never share your Personal Information with any third party who does not explicitly require it to perform the SMS Service. We may use or disclose your Personal Information in any of the following ways:

  • When we have your consent

  • We need to enforce our SMS Terms of Service

  • To third party service providers for processing on our behalf, including to facilitate the SMS Service. When this is done, it is subject to agreements that obligate such third parties to process information only on behalf of Groups at our explicit direction

  • To any affiliated entities, including parents or subsidiaries or other affiliates

  • To respond to a legally presented subpoena or court order; or to establish our legal rights or to defend against legal claims

  • We believe it is necessary to share to investigate, prevent or take action regarding illegal activities, suspected fraud or illegal activities, situations involving potential threats to the physical safety of any person, or otherwise as required by law

We may share aggregated or de-identified information with third parties without notice to you.

Security

Groups takes precautions to ensure the security of your Personal Information, including ensuring that our third party service providers protect the security of your Personal Information. However, we cannot guarantee that hackers or other unauthorized personnel will not gain access to your Personal Information despite our efforts. You should note that in using the SMS Service, your Personal Information will travel through third party infrastructures which are not under the control of Groups (such as third party SMS delivery platforms or your carrier network). 

Opt In and Opt Out

You may opt into or out of the SMS Service in accordance with the SMS Terms of Service

We reserve the right to send you certain communications relating to the SMS Service, such as announcements and administrative messages, without first offering you the opportunity to opt out of receiving them.

Children and Intended Audience

The SMS Service is not intended for children under 13, and Groups does not knowingly collect information from children under the age of 13. 

The SMS Service is intended for residents of the United States only.
